our little glam mode.

I want to get into my soapbox so we can

Today's soapbox is really simple. It's about love and friendship.
I think that it's very important the season that we're
in is to grab hold to those that we love,
not necessarily focus only on the negative that is out there,
because it's a lot going on, but also to embrace

the here and the now, those who have the heart
for us, those who love us and know us, grow near,
draw near to them, and make sure that what you
put out in the world is good and please into God,
and make sure that what's returning to you and you
maintain is good and pleasing to God. And we can
only do that through community and through connections. So I

I love her and appreciate her. One of my most
favorite recent memories I've had of hers when she came
to visit Felman, which is the school I go to

for homecoming, and we went to go see all of
these sororities performed together and we had the best time
at dinner just talking. I can always go to her
about anything, and she's always there for me. She's the strongest,
most incredible mother, grandmother and friends. And so yeah, I

been together for a very long time, many years. So
I have a gazillion memories.

to talk about because I think it exemplifies exactly who
you are, Monika, just uh, how generous you are. You know,
the scripture talks about when that Jesus says we will
be known by our love one for another, and so

recently it's a recent memory. Actually, I sent out a
message to my community about a financial need that was.

Die your financial need that somebody had, and I asked
my community if they would pray about a seed, and
so sure enough, Monica responded with her seed.

And then she was like, and I got a card.

With an unlimited amount if you want to use that
as well. And she literally would give your shirt off
her back. And she's done that to me before. I
remember when a sushi and I got your shirt.

But she is the most generous, loving person, empathetic, She
will celebrate anybody has so much joy. I just love
her and I'm so excited that you're part of my
life and we've been together all.

Want, yes, So I wanted to just simply say just
to remind you guys. I know we made this show
about love and friendship and and everything, Torrid, is this
something you want to share with us right now?

So I just want to let you know, remind you
of our services. I know this was a short show,
but Attorney Johnson is Will's estate planning all things airship issues.

want to tell you about scams, especially to my elders
in the community.

Remember, do not let.

Speaker 6 (30:53):
Strangers into your home. Do not sign the document. It's
a power of attorney. They'll tell you that they that
they want your house. I'm sorry that they want to
buy your home, and in order to buy you have
to sign the documents. In order for someone to view
your home, you do not have to have them sign anything. Again,
in order for somebody to view your home, you do

(31:14):
not have to sign anything the documents that they want
you to sign. When they're just simply viewing your home
is a contract, and if you do not sell to them,
then they will place a lean on your house. The
second thing that they're having you sign is a power
of attorney that gives them authority to make decisions of
regarding your home, including giving it to someone else. Why

(31:35):
would you give someone else authority to make a decision
on your behalf? If you're able body, why would you
give someone authority to make a decision on your behalf?

Speaker 1 (31:43):
And they are a stranger. Okay, so let's use.

Speaker 6 (31:46):
Some wisdom in this, and when ever you're in doubt,
you can definitely call it an attorney or just simply
have one of your relatives or your loved ones give
you that information. And as always, if it's wills to
state planning, attorney Monika Johnson is right there.

Speaker 5 (32:00):
Yes, yes, I wanted to ask you to talking about that.
Tell people attorney Monika, don't be afraid to call you.
They need a will they do.

Speaker 2 (32:11):
And bet I'm so glad that you said that, because
this is another tip. This is something that we are
seeing quite often. If you are in a blended family,
you've been married before, you have children with someone else,
you're in a blended family, and you purchase a house
with your spouse in the state of Tennessee.

Speaker 10 (32:35):
That means that you all have.

Speaker 2 (32:37):
An undividible interest, and so the survivor of the two
of you will own the entire home. Okay, And so
what that means is you're leaving it up to chance
to see who's going to pass away first, because if
the wife passes away first, the husband remarries his new wife,

(32:58):
and only his chi children are heirs to the property
and not your children. Even though you lived in that
house for thirty years and you built it up, you
paid it up.

Speaker 10 (33:08):
And so these are the reasons why.

Speaker 2 (33:11):
And I know I sound like I'm fussing, but I'm
passionate about it. You have to fuss, but this, this
is why we say you need to get a will.

Speaker 10 (33:18):
I'm not you know this. I don't have a million dollars.

Speaker 2 (33:21):
Yeah, but you're in a blended family and you care
about your four year old grandchild that you want to
make sure is taken care of. We need to make
plans for that. Do not be afraid. Also, the other
thing that we're seeing is those not making plans for
their special needs children. Now, Mama, you know that your

(33:43):
son has lived uncle has lived with you all all
his life.

Speaker 10 (33:49):
He's never married, he doesn't have any children.

Speaker 2 (33:52):
You've taken care of him financially, mentally, physically, everything. And
what's gonna happen when you go, Mama, If you don't
have a plan in place, you can't just expect that
by some miracle, somebody's gonna just you know, or walk in.

Speaker 1 (34:08):
And take care of it, or even one better.

Speaker 6 (34:09):
Because the kids of the promised child who was promised
the inheritance, they'll come in and say, Mama always said
I could have. Well, Mama, you didn't put it in right. Therefore,
you are leaving it up to the integrity of your
children to quote unquote do the right thing.

Speaker 1 (34:25):
They are not.

Speaker 6 (34:26):
They are going to do what is in their best
interest now that you're gone, and they may be jealous
or upset the way that you navigated life prior to
That's the reason why we got to put it in writing.
And then in ladies, let me tell you this, And
when these men die and these houses because they never
would marry you, you've been dating them for ten and
fifteen and thirty years.

Speaker 1 (34:46):
No judgment there.

Speaker 6 (34:47):
But what the problem is you think that person loved
you so much a they did not love you enough
to marry you. The reason why I'm bringing that up
is because then when they pass away, you're thinking that
you should get something because you were in his life
fifteen years.

Speaker 5 (35:01):
Ma'am.

Speaker 1 (35:01):
He wouldn't give you his last name, and he didn't
leave you his house.

Speaker 2 (35:04):
And Tennessee does not have common law marriage. Let me
say that again. There is no comment. I've been living
in with him. That is my husband, not in this state.

Speaker 6 (35:14):
And now, no matter how much you lie and tell
people y'all married, no you're not. And the reason why
that's important is because you call me and you call
attorney justson, Oh he loved me, Well, then you all
need to put that in writing. He doesn't have to
marry you, but what he does need to do is
have a will and attorney Johnson. Can't a boyfriend give
his assets to his girlfriend or his forever fiance.

Speaker 2 (35:36):
Absolutely he can do so by will or trust. You know,
he can actually add her on to the deed. Of course,
there's some risks with that and so we don't always
recommend that. But yeah, there's a number of ways that
you can make a situation a little bit more fair, absolutely,
for what will happen when the individuals began to pass away.

(35:57):
So I'm gonna always encourage you know that you put
it in writing, don't leave these very important things up
to chance. I know people who have pets, and my
dad was one of them. He loved Gallifray was his dog. Okay, Gallifray, Okay,
he loved that dog so much. He was so concerned

(36:20):
about and the dog knew when my dad was sick, right,
because they have this connection.

Speaker 1 (36:24):
Really.

Speaker 2 (36:25):
Yes, So when you have a pet that you know
and that you love in that way, and you know
you're sick and you want to make sure that your
pet is taking care of guess what bell we do
pet trust.

Speaker 1 (36:39):
Trust to share.

Speaker 2 (36:40):
But what did your dad who got gallif It was
a ranch in California where he could run run around. Yeah,
it was a ranch that we were able to give
him to because he was too I couldn't bring him
to Tennessee. Gallifrey weighs more than me. He weighs more
than me. So so he's happy now and he's free. Yes,
But the point is, you can even have a trust

(37:02):
set up where you have a trustee to manage.

Speaker 10 (37:05):
You can have money set.

Speaker 2 (37:06):
Aside to make sure that your pet goes to the
you know, to the veteran, to.

Speaker 6 (37:14):
Make sure that they're groomed, that you would have cared
for your pet. That's that's very intelligent to do.

Speaker 1 (37:20):
That's right.

Speaker 2 (37:21):
And then you you want to make sure you do
this not just in the event that you pass away,
but we also do what's called incapacity planning.

Speaker 4 (37:29):
Right?

Speaker 2 (37:29):
Does that mean that means that we're going to plan
now even though it may never happen, but we're gonna
plan for what will happen if I'm ever in a
coma for seven months. Who's going to be over my finances?
Who's gonna make decisions about my health? You make those
decisions in advance so that you're not in a conservatorship

(37:55):
like Wendy Williams for example. You know, you want to
make sure you have a plan in because we don't
know what the future is going to hold, so if
we have to stop leaving things up to chance.

Speaker 6 (38:06):
So if they call you regarding the incapacitated issue, would
that be a trust or will or is that just
a part of the state plan.

Speaker 10 (38:13):
It's part of their overall plan.

Speaker 2 (38:15):
So we'll probably have different powers of attorneys, including a
general durable that will allow them to make financial decisions
if the assets are in the trust. The incapacity planning
is in that trust document that will allow successor trustees
to come in and manage the property or manage the assets.

(38:36):
So yes, it's part of your overall plan. And that's
why it's so important for you to talk to somebody
who's going to give you a holistic picture and not
just piece meal. You need to look at your entire
estate plan, including you living for a long time.

I just wanted to add what you said, Attorney Ersla
and when you were talking about living with somebody for
all these years, and explain this. Ladies, you living with
a man all these years, he's still married, oh and
he dies.

You're not the wife, Okay, the.

Speaker 5 (39:16):
Wife is going to the wife gets the social or whatever.

Speaker 1 (39:21):
I am not here.

Speaker 6 (39:22):
None of us are here to judge you for being
a forever fiance. We're definitely not here to judge you
for living with your man. But what we're trying to
really and truly discuss with you is being a forever fiance,
being a living girlfriend. That does not give you any
legal rights in the state of Tennessee. So we're trying
to ground you.

Speaker 1 (39:40):
Now.

Speaker 6 (39:41):
We know that mister Jimmy love you, and you know
what I mean. We know that mister Jimmy is still
married to Mary Sue, and but we also know that
he's been with you in church, holding yourselves out as
husband and wife for twenty seven years. But that does
not make you missus Jimmy. You are still you know,
lorna special friends, still the special friend, and it will

(40:04):
be in the obituary that way. Therefore, But you believe
that because but this is serious. You believe that because
you've paid the mortgage. You believe that because you've paid
the rent. You believe because you have cared for this
man all of these years and he's dying and you
have been the only one by his side, that that
gives you some level of legal hierarchy. It does not.
And I'm tell you the worst thing that happened, Attorney Justson,

(40:27):
what happens if mister Jimmy and the mistress I'm sorry,
the fore ever fiance, if they bought a house together,
but mister Jimmy still married to Mary Sue. Mister Jimmy died,
who gets the house.

Speaker 2 (40:38):
We've actually had a scenario exactly like that. And in
that scenario, the the girlfriend broke up with the husband
about five years into the relationship, but she stayed into
the house, stayed in that home for another twenty years.
She paid the mortgage by herself. She had no more

(40:59):
contech with the husband. But because the girlfriend and the
husband purchased the property together and he was untitled.

Speaker 1 (41:08):
It was not her husband.

Speaker 5 (41:10):
It was not her husband.

Speaker 2 (41:11):
Remember she's the girlfriend right when that husband. When that
husband passed away, this girlfriend could not understand why she could.

Speaker 1 (41:21):
Not sell her house.

Speaker 2 (41:23):
I've been living in this house for twenty five years,
you have. But guess what, your ex boyfriend, your ex,
your ex's wife owns half of your house. Right and
so now we ought to go to this woman and
negotiate with her to transfer over her interest to you.
So you all have to plan in advance. We're not

(41:44):
gonna just leave it up to chance. And that's a
horrible situation.

Speaker 1 (41:47):
The same thing with children.

Speaker 6 (41:49):
It ment fellas you know, especially my senior citizens. You
eighty years old, but you got a two year old
child that you never told your wife about. Please trust
no and believe that when you pass away, guess who's
gonna be sitting at that front row, that lady and
that new child. And then when it's time to divide
the assets, and you didn't make provisions for that two
year old. Oh it's coming up and out. And you

(42:12):
know you took that blood test. You know that's your baby,
and that child it does have a right to inheritance.
And so I would say, hey, even though I understand
that you know you may not want to discuss that
while you're alive. I mean, you know you don't want
to get cut right there. But we can make provisions
in which in your will where you may write a
letter to your family explaining the situation. Because none of

(42:32):
us are perfect, you know, but for the grace of God,
we would all be in the same position, you know,
like we're teasing with the men and calling your forever founce.
But be honest with you, I understand there are reasons
why we don't choose to marry and we just want
to remain connected to someone. But let's just get our
legal affairs in order. That's let's just get so get
that telephone, ne call it turning Monika Johnson. The number
