the State of Maine over transgender athletes in school sports
and joining me. Now we have Maine's Attorney General, Aaron
fryy erin thank you so much for being here. So
the DOJ alleges that your state is violating Title nine,
which mandates people opportunities for men and women in sports.

What do you say to.

That, Well, we understand what they're arguing, as has been
made clear by our governor back in February, and as
we've maintained from the very beginning, we are confident that
Title nine, along with the Main Human Rights Act, supports
the physition that our state is taking, which is trans
athletes do have the right to participate in a sport

that they identify with. It's been happening for years, it's
been done safely with all respective privacy, and for Maine
to change course now, I believe would put us in
contravention of what Title nine and the Main Human Rights
Act really support, which is making sure there's access, all
equity and engagement in sports. So that's why we were

having me. What is your response to the Attorney General
from Maine and his assertions.

That they're ridiculous.

The idea that banning males from women's sports would be
a Title nine violation is completely absurd when the whole
point of Title nine was to protect women's sex based
rights in the education system and a boy saying he's
a girl and that it doesn't protect gender identity Title nine,

it protects biological sex. You probably are aware that just
last week the Supreme Court in the UK made the
ruling that you actually have to be foreign a woman,
be a biological woman to qualify as a.

Woman under the law.

Now, no one would think that you'd need, you know,
the Supreme Court to decide that. But here in the
US we seem to be moving in the opposite direction.
But his assertions are ridiculous, They don't make any sense.
And the fact is the federal law is that there
can be no boys in girls' sports. You know, Trump

signed an executive order on February fifth, now this isn't legislation,
and unless there is legislation, that could go away when
we have a new president, but right now that is
federal law, so everything he says is ridiculous.

Jennifer say, our guest. I go to two things based
on our previous conversations, Jennifer that I was a former
athlete high school and Juco, you are a former gymnast
and a very accomplished one. That really stand out to
me in this argument. First of all, everybody that argues

for transgender participation in athletics that i've has not participated themselves,
with the exception of maybe super Bird and Megan Rapino,
but they didn't have to deal with this issue during
the era which where they came up.

And for me, it's the point that you.

Made about gymnastics itself. For instance, boys and men have
to do the rings, the pommel horse, the parallel bars
rather than uneven bars, and the vault and the floor
routines that the women do. So if there is no
difference and a male can just identify as a female
and do those different events, then why do we have

separate men's and women's gymnastics events.

Speaker 6 (03:34):
Yeah, and why today it's the Boston Marathon, which just happens.
Is the women's qualifying time for half an hour slower
than the men's time. I mean, they know it. They
know that there is male advantage that makes men stronger
and faster, you know, greater oxygen intake, for greater endurance.

You know.

Speaker 6 (03:55):
The list goes on and on, but they don't they
don't care, it seems.

I mean, it's obvious in the rules.

You know where the teas are placed in golf, where
the net is placed in volleyball, it's lower in women's
volley in women's volleyball, and the ball is smaller in
women's basketball. I mean, the list goes on and on.
I think the Boston Marathon really illustrates the point. The
qualifying time for women is a half an hour.

Slower than it is for men.

Speaker 6 (04:24):
And yet today there are three categories at the Boston Marathon.
There's men, there's actually a non binary category. Qualifying times
for non binary are the women's times a half hours slower,
And there's women and men can compete in all three
of those categories. There is no category that is protected
and for women.

This continues in Colorado as well with House Built twenty
five thirteen twelve about gender identity and what the parents
will affirm it. But this gets the basic issue of fairness, Jennifer,
And where even Gavin Newsom, the governor California, who has
conto plating we know, run for president twenty eight acknowledged
to Charlie Kirk, Yeah, it's an issue of fairness that

is not fair because if we're going to play this out,
there would be an equal number of biological females who
identify as male trans men participating in the men's divisions
of any sport. And Jennifer, I'm having a difficult time
coming up with even one.

Speaker 6 (05:25):
Yeah, there aren't any. And you know, let me just
say about Newsome, the governor of my former home state.
He did say that it wasn't unfair, but if you
listen to the entire statement he made, he didn't end
by saying he was going to do anything about it.
And in fact, it's still happening in California and other
Blue states. There have been sixty instances of boys winning

high school track events in girls' divisions so far this
year alone. So that thing that a good portion of
those are in California. So the thing that never happens
sure does have a lot. But let me tell you
another story that just happened over the weekend. Because you
make a really good point, there aren't women who identify
as men that are competing in the men's category. Suddenly

identity is not so important that it be validated. Nicky Hills.
I don't know if you know who she is. She's
an Olympian. She read in Paris over the summer in
the fifteen hundred. She's a middle distance runner. She says
she's non minor. She is neither man nor woman. According
to her, some days she feels very much like a man,
some days she feels like a woman. Sometimes she feels
like neither. She both in a video this weekend attacking

a woman who ran in the Boston American Today named
Natalie Daniels, who we have partnered with, who did an
interview with us basically saying what we all believe, or
eighty percent of Americans, that the women's race should be
for women only. Well, NICKI attacked her, and here's what
I would say to Nicky. You're not a woman, so
why didn't you choose to run in men's in the Olympics.

Why did you choose to run in women? Because she
sought every advantage for herself and she knows that she
wouldn't qualify in them. Her very best time that she's
ever achieved doesn't get her anywhere close to competing in
the Olympics and men and then she sort of poopoos.
Natalie Daniels is like, what, why do you care? It's
all supposed to be friends, about fun and making friends

and just finishing the rights, which is just so condescending.
She clearly doesn't think that she's trained her whole life
to get into the Olympics. Natalie Daniels has trained us
as hard. Just because she's not Olympic level doesn't mean
she doesn't care where she places. And guess what, that
nan that run in the women's division displays another hard
working woman. So you know, I just it's so frustrated

because they know, they know, but then they attack us
and they weaponize our empathy and they call us bigots,
and then women are too afraid to stand up and
demand fairness. But we're going to keep talking until.

that the Attorney general from Maine was maintaining that is
a protection of Title nine, Jennifer, to allow trans identifying

females to compete in women's sports, when the point you
just made is a valid one and needs to be repeated.
It is displacing biological women scholarships, opportunities, medals, championships, left
and right.

Yeah, I mean the reason he said that is because
the Left operates under this lie that trans women are women.
They operate under this lie that if you say you're
a woman, you are a woman, and therefore this non
woman is protected under Title nine. But Trump reversed all
of that with the executive orders. He went back to

the original meeting of Title nine, which is really what
we should be operating under, and it's pretty cut and dry.
He also date the attorney general that it would be
a violation of their state law, which prioritizes gender identity,
but the federal law is no boys in girls sports.
According to the February fifth executive Order, and according to

the Constitution, federal law, Trump's state law. So he really
ought to get on board. But me seems willing to
die on this hill. They really seem willing to die
on the sort of letting boys field girls trophies. And
I just have to scratch my head that they think
they're like civil rights civil social justice warriors fighting this

fight to take rights some opportunities away from girls. I
don't understand it. There's some sort of mass like coosis
that's taken home.

You mentioned Olympic standards a couple of times, and it
leads me to this very good question from a Texter.
What is the World Olympic stance on trans participation? And
it seems to me that that varies. I'll let you
clarify as well. Whereas in swimming, Leah Thomas, etc. Was
not permitted to participate and compete as a female. And
yet the really lasting image for me from the last

Olympic Games was Imani Khalif of Algeria defeating Angela Karini
of Italy, who was in tears forty six seconds into
the match, saying.

She'd never been punched that heart in her life.

Speaker 4 (10:17):
There is a dispute as to what gender Imanic Khalif
actually is identifies as was born as is it x
x Y. I don't know any of that, but what
can you tell us about the Olympic standards? Are they
going to be handled sport by sport or do you
think the IOC is going to rule on this before
the next Summer Games.

Yeah?

Speaker 6 (10:35):
So right now it is handled sport by sport, And
you're correct the governing body for swimming does not allow
transidentified males to compete in women. It is also true
of the governing body for track and field World Athletics
that is led by Sebastian Coe.

There is a newly.

Appointed or elected head of the International Olympic Committee. Her
name is Kircy Coventry. We don't know where she stands.
She has made some statements saying that she believed that
women's sports should be protected and for women only. Should
not taken action on this yet, I mean the IOC
as well within its right to do so. Currently it

is governed by each individual's fort body. And the reason
we saw Amani Calik, who is not tramed but is
a male with a chromosomal abnormality. He brought the doctors
and his parents probably and he himself thought he was
me Mail up until a search wait in his life puberty,

and I think at this point there is evidence that
he knows he hasn't boxed Maile, but he's still competing
in the.

Women's division.

Speaker 6 (11:43):
Because boxing was overseen by the IOC and not that
international sport governing body because of some controversy with IAB,
and the IOC allowed it. Their rule was, if your
passport says you're a woman, you are, but you know
paperwork is one of ball.

Sex is not.

Very well put, Jennifer say our guest, now, Jennifer, it's
been my opinion, and we've seen kind of one off
examples here and there.

Certainly NCAA swimming with.

Riley Gaines becoming a voice and affiliated with you through
XXXY Athletics and her battle, her campaign and all the
heat that she has taken against Leah Thomas's participation. We
know about the case of Peyton McNabb in volleyball suffering
a spiked volleyball to the head that has inflicted permanent damage.
Gavin Newsom was asked about a track and field athlete

by Charlie Kirk in California. We've seen this happen as
well in Connecticut, so they're all over the map here,
and we know that perhaps this showdown between Maine and
the Trump administration might get us some answers. But it's
always been my theory that we would need to see
something so ridiculous like a biological male dunking in the
WNBA for it to get the notoriety, the traction, the

attention that would finally put an end to this. Is
that what it's going to take, or are we going
to arrive at the right conclusion sooner than that?

Gosh, I just.

Speaker 6 (13:04):
Don't know what it's going to take at this point.
I mean, we've just had these disturbing image images that
you cited from, you know, the Olympics, with Riley standing
next to Will Thomas, you know, looking so obviously male,
and yet the Democrats are bringing in their heels. They
seem to want to just give election to Republicans time

and time again on this very silly issue that it's
not silly, it's really about defending biological reality. But they
it's silly that they're digging their heels in on it.
That's what I meant, And they seem to be. They
will not admit that they are wrong. They will not
admit that they are not only out of touch with
the American people, but with my biological reality. And I

I don't know what it will take, but I will
tell you this, I'm going to keep fighting. And here's
the other point I will make is, eighty percent of
Americans agree with us. It really doesn't feel like that
when you're out here talking about it. The minority is
very loud and very bullying and harassing, and it keeps
most of that eighty percent quiet. And I think what
it will take is that eighty percent standing up and

saying we're not going to tolerate this anymore. At that point,
the Democrats might actually come around, because you know, they'll
just have no shot at ever winning again.

Jennifer say our guest, and one final question, Jennifer comes
to me from my colleague Mandy Connell, and that is
about California. You left California, you came here to Colorado.
It's one of the reasons I love having you on
these stations here in Denver because you speak to it
from a local viewpoint.

But you left California.

You left Levi Strauss and we see Gavin Newsom, as
we mentioned, maybe moderating his positions on this.

Whether or not he'll do anything or he's just doing
it for political expediency, that's a different question. And I
just want to get your take, your input, if you
have any about the new mayor of San Francisco and
Daniel Lurie who succeeded London Breed, who is an heir
to believe Strauss a fortune, and whether or not you
think that might be a step in the right direction.

Basically, Mandy's question was does.

She have reason to believe that he might make things
better in San Francisco.

Oh gosh, I'm trying not to pay attention to local
San Francisco politics. I'll be super honest, you know, I'm
trying to get more acquainted with denbra politics in Colorado politics,
and I'm very concerned about the direction we're headed here,
and in fact, i'm the chairperson for about initiative here
in Colorado to protect girls sports. But from the little

bit i've read people's saying, I think encouraged as far
as the direction he's going to clean up the streets
and attempt to sort of end this rampant drug use
on the streets of San Francisco and to sort of
put businesses first because that will help put employment first

to the citizens in San Francisco. So, you know, I
think the initial days are encouraging, but I honestly I'm
trying not to stay too connected to my former state's politics.
But you know, you know, I served didn't finish the
thought about Gavin. You know, he did make much ado
in his conversation with Charlie Kirk about how it's not fair,

but he ended his statement by saying, but we're picking
on a vulnerable population. And so really the subtext of
that was we need to let these boys have what
they want or else they, you know, will kill themselves.
And you know, who cares what the girl's rights are
in terms of privacy and fairness. These boys are really sad.
I'm obviously paraphrasing. It is not the responsibility of young

female athletes to protect the feelings of boys who are
clearly tough. You know, it's not their responsibility. That's like
saying to a woman who is abused by her husband
and that husband threatens, you know, if you leave me,
I'll kill myself, that she has to stay with him
so he doesn't kill himself. It is not the responsibility
of these girls. But I think when you listen to

Gavin's entire statement, he makes it very clear he is
not going to do anything on this.

If the DOJ pursues California as well, they might be
convinced otherwise. I think they're trying to make an example
of Maine, and I hope they.

Always appreciate your input and where I come down on this,
again from a person who's participated in sports my whole life.
I mean, go back to age eight when I was
in Little league baseball coaches pitch we call it bantam
where I was, and there were no girls in the
boys sport there, but there certainly were no boys playing

girls softball that was for the girls, and if I
were to say tomorrow, you know, I identify as a woman, Well,
people would laugh and you would think that's ridiculous, and
I would agree with you.

But there are shades on a spectrum here.

I agree with that. I agree with that assessment. But
how is the Leah Thomas case that much better? In
other words, at what point can a man become a
woman where it's a level playing field. I would argue
that it cannot be done, at least not in an
athletic realm, especially when Lea Thomas is fully intact, when
through all of male puberty, had all of those advantages,
competed as a male swimmer at the collegiate level, and

then after two years I think it was of hormone therapy.
I'm a woman now, I don't think so I can't
go there, not from a strictly competitive sports standpoint. And
Jennifer made the point about the Boston Marathon. Today, biological
males could compete in all three categories, the male, the
non binary, and the women's division if they identified as female.

children are a lot better artists than crooked Joe Biden's
crazy drug addicted son Hunter. Right, he had art and

look at it. It was way too much, and it

kids created much better art than he ever created. And

Court said someone needed to be returned, that you would
abide by that. You said that on your first one

must be facilitating.

Why didn't you just say, isn't it wonderful that we're
keeping criminals out of our country? Why can you just
say that? Why do you go over and over and
that's why nobody watches you anymore?

Well, she likes to speak at a turn, right, she talks.
When I don't talk to her, she talks, and we
would love it if she would just stop talking. Right.
But she also is a thief, right. She's stole Scott
Presler's look. You know, she looks a lot like Scott Presley.
He's a tremendous guy, helped me get elected, and she
stole his look. And he says that she looks good,

which means she probably looks like a guy, right, Because
you know what Scott is in't who's a tremendous person.
We love Scott and he has said that a few times.
But she really bothers me because she stole his look.
And she's very annoying. And she's really bad at her job.
You know, she's really bad. But she doesn't get under
the skin. Nothing gets under her skin. I have the
thickest and most incredible skin. It's like chain mail, you know.

And it's not that chain mail that comes from China
which has a terriff. It's being beautiful, arrogant steel chain mail.
And nobody gets under my skin. But she's a stupid person.
She comes from a stupid network, and she carries herself
like a fool and she ought to get better if

that because people are not going to keep watching her.

other things trending down. There's virtually no inflation. With these
costs trending so nicely downward, just what I predicted they
would do. There can almost be no inflation, but there
can be a slowing of the economy unless mister too late,
a major loser, lowers interest rates. Now Europe has already
lowered seven times. Powell, talking about Jerome Powell, the Chairman

of the Fed, has always been too late, except when
it came to the election period, when he lowered in
order to help sleepy Joe Biden later Kamala get elected.
How did that work out, mister president, Are you responsible
for the markets trending downward by calling Jerome Powell mister
too late and a major loser?

No, we're not responsible for that, right, We're only responsible
when the markets go up. That's rule number one. You
know that. But he is a dead guy. He's a
stupid guy too. He has a lot of stupid people
and he's one of them. And he takes too long.
You know, he's sitting on his hands and he's sitting
for too long. He's been sitting for too long. Thankfully
he's not he's not the size of a Chris Christie

your governor, right, Jared Polus. If he was that big
a hand, he would be broken for sitting on them
for so long. But you look at it. He has
done very bad job and he's earning us. And if
the markets are going to react when I said that
he's doing a bad job, well, the markets are going
to react a lot because this guy always does a

bad job. He needs to get his head out of
you know, where his rear end. He's got to get
his head out and he's got to help us out.
He tried to rig the election for Kamala and Sleepy
Joe and it didn't work. But he needs to get
better and right now he's not doing ready and doing
a very good job. Too little, too late, And we
can say that about him, by the way, on a

number of things, too little on a number of things,
believe me.

think he's always liked tariff's. I don't necessarily completely agree

If it doesn't, it'll all be on him. Period. But
continue with this text. That wasn't one of the issues,

meaning tariffs I was thinking about. Some would be TikTok, COVID,
nineteen vaccines, abortion, evs, presidential nominees, releasing tax forms, and
so many people in his life he either disliked and
not likes or vice versa.

That last point is absolutely fair. If you like Trump,
he likes you.

If you don't like Trump, he doesn't like you, and
he'll JD is an example of a guy that didn't
like Trump and now that he.

Does it, well, he's okay. He learned.

And as far as TikTok, I disagree with Donald Trump
on TikTok. I think it's a Chinese spy app. I'm
not a big fan of it. He wants to keep
that platform open. I would be in favor of something
like Governor and De Santis says, which is forcing a
sale of TikTok to a non Chinese government run entity,
if we are to have it here in the United States.

They don't allow American platforms there. They don't allow Twitter
or x there. If you're a Chinese citizen. COVID nineteen vaccines, Yeah,
that turned out to be very wrong.

Operation ORP speed okay.

He was advised by doctor Deborah Books and doctor Fauci,
and I was never in favor of mandatory vacs experimental
vaccines that were mr NAA, based that it could not
be proven, it could not be known. We did not
have the case evidence the studies required to determine whether

it was a prophylactic vaccine, meaning it stopped infection the
way that Rachel Mattle lied to her audience, and those
in her audience don't care that she lies to them,
I would be I'd be pretty insulted by that. But
that it stops both infection and spread, it didn't either.
It blunts symptoms. For those with comorbidities like my father

who is seventy eight years old and has COPD, then yeah,
if you have those then perhaps you should get the vaccine.
It will blunt those symptoms. But the youth of America
should never have gotten a vaccine.

There was no evidence to support that.

So, yeah, these are You're pointing out areas of disagreement
that I have with the president, and he hasn't really
cleaned that up.

Not that one. You're right, you're right on that one. Abortion.

I think he has evolved on to a moderate position
from a pro choice one. I don't know his ev stance.
I don't know what you're talking about there. And the
tax forms, Yeah, that's an inconsistency. You are correct on
several of these texts, So kudos to you, and I'm
willing to admit that. Yeah, there are areas of disagreement
that I have with the President. Not a lot of
