Speaker 1 (00:00):
My name is John Mounts. I'm filling in for jt In.
Every week, we always have our weekly legal check with
one of our legal guys who knows his knows his
way around the courtroom. Jeremy Rosenthal joins us. Now in Jeremy,
I'd like to talk with you about one kind of
funny story and one more serious story. Let's start with
the Walmart customer who was using one of those self

(00:20):
checkout kiosks and he overcharged himself for an avocado and
then he called the police.

Speaker 2 (00:27):
That's right, he called the police and claimed robbery. I
don't know about you, John, I get my news from Reddit.

Speaker 3 (00:35):
I mean I could go to like the New.

Speaker 2 (00:39):
York Times or Fox or or whatever BBC World Service.
But I like my reporters that have like at six
nine six' nine at the end of their user, name.

Speaker 3 (00:51):
RIGHT i like not knowing where my news is coming.

Speaker 1 (00:54):
From that's really. Best. Yeah this was On.

Speaker 2 (00:57):
Reddit this guy On reddit, SAYS i saw guy who
was checking out From walmart overcharged. HIMSELF i think thirteen
hundred dollars for. Avocados in, REALITY i think he meant
to charge himself maybe thirteen. DOLLARS i don't know what
your avocado budget. Is mine's not quite thirteen hundred and.
Listened he called the, police claiming That walmart's robbing.

Speaker 3 (01:21):
Him And i'll tell you, WHAT i hate saying. THIS
i kind of get his. Point you, Know.

Speaker 2 (01:27):
I'm not saying anybody At walmart needed to be arrested for.
This but, look if this guy walks out and accidentally
takes a free, avocado they're going to charge him with.
Theft AND i, mean if you overcharge, yourself Is walmart
stealing from? You these are the deep questions today THAT
i just don't know that there's right answers to.

Speaker 3 (01:48):
THEM i, mean what do you what do you think?

Speaker 1 (01:50):
HERE i don't, know, well, WELL i don't get how
IF i could see IF i screwed up, it Because
i've done this, Before Like i'm getting in a, Groom
i'm checking myself out one of these self checkout kyostin peep,
peep peep, beep AND, i oh darn. IT i did it,
twice And i've had to because you can't just undo that.
Right you, know you're not the, manager you know you
don't work, there so you have to wave down one
of the store, employees have them go over punch their

(02:10):
overie code in and take that extra beep, off and,
okay you just save yourself a dollar seventy or. Whatever
but if you charge yourself THIRTEEN i, mean WOULDN'T i
notice WHEN i swiped my debit card and expecting a
bill of like ninety seven dollars and a set it
was thirteen hundred and ninety seven. Dollars WOULDN'T i scratch
my hand and, go something's wrong. HERE i think it's
CAVEAT m tour on this, way maybe you. Should you

(02:32):
should have noticed that you just charged, yourself you, know
like a thousand times what you were expecting to.

Speaker 2 (02:37):
Charge, look you're a radio, host so probably that kind
of money is not a big thing for.

Speaker 1 (02:42):
You oh, yeah, No, Orri it'spenders radio. Station yeah you.

Speaker 3 (02:44):
Know but and, Listen i'll tell you what CAVEAT m tour.
Man this is.

Speaker 2 (02:50):
Awesome that is that is some good legal latines right
there right. There that that's that's the buyer. Beware good for. You,
I'm i'm that's pretty. IMPRESSIVE i like. That but, yeah
you're you're you're completely. Right, look the only reason to
go through the self checkout is it will card you
if you're buying, alcohol and nobody cards me. Anymore, otherwise

(03:10):
in my, Mind i'm not getting health. Insurance i'm not
getting dental or vision. Insurance i'm doing their job for,
them AREN'T.

Speaker 3 (03:18):
I uh.

Speaker 2 (03:19):
So, yeah a lot of big philosophical things that we're
wrangling with, here not the least of which Is.

Speaker 3 (03:24):
Reddit.

Speaker 2 (03:25):
Right.

Speaker 1 (03:26):
YEAH i was gonna, say this whole thing hinges on
something somebody saw and then reported On. Reddit so the whole,
thing the whole thing might might be completely made, up
but it. Is it is. Necessary it is an interesting
thing because these self check And i've seen before these
people who they they, try they try and sort of you,
know sneak something. Through they're going to see if they
can get away with something with a self. Checkout, normally
the deal has the, scale, right your your bags are

(03:48):
hanging on a, scale and it knows how much something
should weigh, roughly and if it, doesn't it. Doesn't it
gets something put in there that wasn't. Expected it, goes,
hey you, didn't you didn't just pay for this four
dollars or a four pounds whatever this. Is you just
set down here and you, know you get flagged on.
That so the stores are doing their, best but you
are right THAT i think we're doing their job for. Them, Well,

(04:09):
jeremy let's let's turn our let's turn our attention to
a more serious legal. Issue the attack over this past
weekend of the Two minnesota lawmakers And Governor Tim walls
said that it was politically it was politically. Motivated what
are the details on just how? Politically BECAUSE i don't
know THAT i necessarily buy. THAT i think we're always

(04:31):
looking in a situation like, this who to blame and
who who to? Charge and do we know it was
indeed politically?

Speaker 2 (04:37):
Motivated, WELL i think we're going to learn a lot
more about this, fella Mister.

Speaker 3 (04:43):
BELTER i think what we do know is that he acted,
alone regardless of his.

Speaker 2 (04:48):
Motivations, typically one of the very first things law enforcement's
going to do in these situations is they're going to
execute search. Warrants they're going to get into all of
his computer, devices and you're going to have the media
that's going to do it deep dive to you know,
that you know that the news is going to go up,
there stick a microphone in the face of.

Speaker 3 (05:04):
All the, neighbors and, hey what was going?

Speaker 2 (05:06):
On SO i Think we're going to learn a lot
more about the, who the, what the, where the, when the.

Speaker 1 (05:11):
Why jeremy. What the neighbors say the same thing they always,
say which was he was a very quiet.

Speaker 2 (05:15):
Man oh, sure they, may they. May they may also, say,
look this guy kicked. Dogs he yelled at kids on In.
Halloween but, yes we're but we're going to learn more
about his social media.

Speaker 3 (05:27):
Profiles, uh we're Gonna we're gonna learn a lot.

Speaker 2 (05:29):
MORE i think about, him, hopefully AND i think what
people have to recognize here what this man did was
obviously very. Heinous these these are very frightening. Crimes if
you look at the ring, cameras he's got this mask
on his. Face it's like not to not to make
light of, it but it's like The Scooby doo mask
where the guy peels off the.

Speaker 3 (05:51):
Thing.

Speaker 2 (05:51):
Uh he had police. Equipment he had a police, car
he had the. Sirens uh WHAT i from What i've
seen and, read he had a list of anywhere between
forty five and seventy five lawmakers that he wanted to.
Target the lawmakers That i've, seen all of whom are.
Democrats WHAT i think folks have to remember is this

(06:12):
we have three hundred and forty million people in this,
country and there are going to be.

Speaker 3 (06:17):
Folks out there with a screw.

Speaker 2 (06:19):
Loose and these people might agree with us in part
or disagree with us in, part but that doesn't take
away their own personal.

Speaker 3 (06:26):
Responsibility i'm A Dallas cowboys.

Speaker 2 (06:28):
Fan there are plenty Of Dallas cowboy fans in The
Texas department Of corrections that have hurt a lot of.
People that doesn't mean THAT i excuse their behavior OR
i agree with. Them so regardless of what this guy's
political opinions, are.

Speaker 3 (06:43):
His crimes are.

Speaker 2 (06:45):
Unacceptable The state Of minnesota is jumping in and they're
charging him with everything under the.

Speaker 3 (06:51):
Sun THE. Fbi The feds.

Speaker 2 (06:53):
Are charging him with everything under the, sun and even
potentially the death. Penalty and let's not forget That Donald trump,
himself who this person claims to. Support Donald, TRUMP i
would be the first to tell you that he doesn't
want this guy's. Support And Donald trump's a guy who
got shot at himself last, year SO i think he
can in many ways sympathized with an elected official who

(07:15):
is getting targeted for no other reason than he's standing
up for what they believe.

Speaker 3 (07:19):
In SO i think that there are a lot of layers.

Speaker 2 (07:23):
Here from a legal, standpoint this guy's gonna have a
lot of problems.

Speaker 1 (07:27):
OBVIOUSLY i think a lot of what you see anytime
something like this happens is people try and use it's,
sick but they use it to try and score. Points
they want to try and see who's the win for.
Somebody they want to make this a, win not a.
Loss they want to, Say, okay well it's a win for.
Us because we can pin this on the other. Guy
we can say That Donald trump is. Responsible Maybe Donald

(07:49):
trump didn't pull the, trigger but he motivated this. Guy
this guy Heard Donald trump and he was mad because
of Something Donald trump. Said so he went out there
and he did this at the behest Of Donald. Trump,
Therefore Donald trump is once again inciting violence and is
so disappointing when you hear, that because there are people with,
us as you, said a screwlus who do screwy things
that you cannot say. That, well he read something On

(08:11):
reddit or on some other social media platform and it
made him. Mad so we did, this and so therefore
it's the fault of fill in the. Blank sometimes we
have to take. Responsibility this guy has to take. Responsibility
AND i am kind of Glad jeremy that THE feds
are getting involved, because AS i, understand In, minnesota there
is no death, penalty and so THE feds would be
able to actually be able to give him capital.

Speaker 2 (08:33):
Punishment that's, Right and there's a lot of parallels, here
if you want to draw.

Speaker 3 (08:38):
Some, parallels there's a lot of parallels to.

Speaker 2 (08:39):
The Luigi mangoni murders murder In New, york which is
a very, premeditated very calculated attack that was intended to
incite a broader.

Speaker 3 (08:52):
Movement.

Speaker 2 (08:52):
Right the reason why THE feds want the death penalty
For Luigi mangoni is there, saying, look you wanted to
spark a popular uprising against the insurance. Industry so when
you're when you when you're you're the point of a
of a calculated, attack of a calculated, murder and you
could even broaden that to to to to to Damaging

(09:13):
tesla's and and and labeling that is terror when you're
trying to make a broader point and get people on
your team to, hey, guys let's run out of the
locker room and go Beat.

Speaker 3 (09:23):
Notre dame or or or whatever it. Is if that's
what you're trying to do.

Speaker 2 (09:27):
Here that's. Terror and if that's what this guy In
minnesota was trying to do by having a target list
and trying to do this regardless of what he thought was,
right then that would calculate that that could be that
type of impetus that's going to get you to the capital.

Speaker 3 (09:45):
Punishment, again just because we have the three hundred and forty.

Speaker 2 (09:49):
Million, americans some of them are not going to some
of them are not going to be tethered to. Reality
and a lot of those people might they might be
cowboys fans just like.

Speaker 3 (09:58):
Me that doesn't MEAN i can excuse their.

Speaker 2 (10:01):
Behavior it doesn't mean that that that they speak for
anybody other than. Themselves and, yes ultimately it does come
down to the personal. Responsibility And i'll tell you this.

Speaker 3 (10:12):
Because you use CAVEAT m.

Speaker 2 (10:14):
Tour there's another phrase in in in law school that you,
learned and that is coincidence is not. Causation SO i
think that's also another important thing to keep in mind.

Speaker 1 (10:25):
Here, yes but how do you say that In? Latin?

Speaker 2 (10:27):
Man there's CHAT gpt give me a, minute.

Speaker 1 (10:30):
All i'll let you get back to be on. That
Jeremy Rosenthal thank you so much for joining me On
alabama's morning. News john Mount in FOR.
