Speaker 1 (00:00):
Joining stun for an update on what's happening with the
Luigi Mangioni arrainment and trial as it moves forward. Tian
You Jay Powers our Fox Courts founding it in New York.
Good morning time you welcome.

Speaker 2 (00:08):
In, Hey, good morning.

Speaker 1 (00:09):
So we're moving in the right direction of this thing.
Is he is the guy that well, he says he
didn't do it, somebody else did this, but he's been
arrested for killing the CEO there in Healthcare, Brian Thompson.
So what went down with the arrangments and looks like
death penalty's still on the table.

Speaker 2 (00:24):
I guess well. On Friday he was in court with
his attorney, just with federal court so that there's no
cameras in the court room, of course, but he was
asked by the judge if he understood the endictment and
the charges against him. He said he did. He asked
what he was asked how he wanted to plead, and
he said not guilty and he sat back down. Now he's,
of course pleading not guilty to these federal charges that

(00:46):
include stalking, a firearm offense as well as murderer through
the use of the firearm. He has also pleaded not
guilty to state charges that he's facing in New York
as well as in Pennsylvania. The New York charges are
the more serious because they do include or as an
act of terrorism. As far as what happens next, because
the judge gave the government a deadline of May twenty

(01:06):
seventh to produce all its evidence in the case, it
looks like they've said already that there's probably about a
parabyte of evidence that they have so far, which means
that's going to you know, that's quite a lot of information.
They're going to take a while to get through all that.
The trial is likely to start next year. Now, which
one of them is going to go first, because remember
there's the state charges that's kind of going along a

(01:28):
parallel track with it. The prosecutors have said the two cases,
will you proceed along on a parallel line. The state
case is expected to go to trial first, but Manngiani's lawyer,
Karen Agnefello are Magnifilo sorry said that their team is
going to try and have the federal case take president

(01:50):
because it involves the definity, whereas the state case the
maximum he could get his life in prison.

Speaker 1 (01:55):
Well, let's talk about the state in the federal case.
Why two different juristics, if you will, or two different trials,
what makes this a federal case?

Speaker 2 (02:04):
That's a good question. I mean, I'm not really sure
why they charged him federally. I know that, like I said,
he is facing murder charges in both of these I'm
not an attorney, so I really can't you parse that
down for you. But you know, as we know that
the Attorney General has already said, Pam Bondi has already said,
you know, publicly, that she wants they want, she wants
the government to seek death penalty in this. His attorneys

(02:27):
are you know, kind of using that statement, arguing that
her announcement was a political stunt and it corrupted the
grand jury process and to deprived him of his you know,
constitutional right to do process. So you know that that's
one of the arguments that they're they're making in this. Now,
whether that's going to make any differences your mad brains
to be seen.

Speaker 1 (02:47):
Yeah, it does look like the Feds are going to
be going for you know, the legal papers to get
the formal notice of the death penalty. But the state
maybe back on off on this one here. So when
do they do back in court and what happens next.
I know it's not going to be till next year.
They probably will get to the actual trial, But any
more motions planned and moving forward at this point that
you're aware of.

Speaker 2 (03:08):
Well, like I said, they've gotten to the twenty seventh
to give the evidence in the case, so government does
so that's another that's kind of the next big deadline
coming up. I know whether he's going to be back
in court that day or not, that remains to be seen.
That could be just a deadline for the lawyers to
all go okay, yeah, we got.

Speaker 1 (03:25):
It, all right, very good time you, Jay Powers. Thank
you for the update. I appreciate you.
